GENERAL Terms & Conditions

The general terms and conditions below govern the provision of any product or service procured from ETSI's e-shop.


1. Definitions

·       "Consumer": a Client that is natural person (i.e. not companies) which orders ETSI's products or services for purposes outside of his/her trade or profession,

·       "Client": the person or entity ordering the products identified in the on-line order,

"ETSI": the European Telecommunications Standards Institute, having its registered office at:

2. Steps to Conclude the Contract

To conclude the contract the Client shall complete the order form and submit the order to ETSI by pressing the "submit" button.  ETSI will promptly acknowledge receipt of the order by sending an e-mail confirmation to the Client.  The contract will be binding when this e-mail acknowledgement will be accessible by the Client.

 

3. Authority to Execute the Contract

If the person processing the order is not a Consumer, this person warrants that it has the requisite power and authority to enter into this contract on behalf of its organisation.

 

4. Filing of the Contract

The Client shall keep a copy of the general and special terms and conditions of this contract and of the order submitted.  ETSI will keep an electronic copy thereof and will provide a copy when requested by the Client via fax or e-mail containing the order number.

 

5. Orders Conditional to Availability

The order of products presented on the ETSI e-shop are subject to availability of stocks.

 

6. Customs Duty

Customs duty, if any, will be borne by the Client.

 

7. Defective product

ETSI will replace any defective product returned to ETSI within 3 months of the order, save if the defect was caused by the Client or during shipment.

 

8. Cancellation

If the Client is a Consumer, he/she may cancel an on-line purchase by sending to ETSI, by e-mail or fax, a cancellation request within 7 days from the date of receipt of the products or, for services, 7 days of the receipt of ETSI's acknowledgement of the Client's order. 

Such cancellation right does not apply to the provision of data, information or software provided on-line or provided on DVD ROMs, where the DVD ROM package seal has been torn off.  Details of the purchase order and of the on-line transaction must be sent to ETSI along with the bank details to allow ETSI to proceed to the refund.  The Client shall return the product to ETSI at its costs prior to receiving the refund.

10. Proof of the Contract

The electronic records registered on ETSI's electronic archiving system  shall be admissible as evidence to prove the existence, the date and time, and the terms and conditions of the contract with the Client.

 

11. Termination

Either party shall have the right to terminate the contract if the other party breaches its obligations and fails to remedy such breach within 7 days of being notified of the breach by the non-breaching party.

 

12. Liability

ETSI's liability to the Client shall be limited to the price paid by the Client to ETSI for the product or service giving rise to a claim by the Client.

 

13. Governing Law / Competent Tribunals

The Law applicable to this transaction is the French Law.  If, however, the Client is a Consumer, then the consumer protection provisions, which are of public policy, will apply.

Any dispute between the Parties which cannot be settled amicably between, shall be submitted to the competent Court or Tribunal of Grasse (Alpes Maritimes - France).

If, however, the Client is a Consumer, then any action brought by ETSI shall be before the competent Court or Tribunal of the Client's place of residence and any action brought by the Client, at his election, before the competent Court or Tribunal of Grasse or of the Client's place of residence.

 

14. Data protection

The data provided by the Client to process the order will be stored in ETSI's Client data base.This data will be kept confidential save that, Experian, the operator of the Payline® secured on-line payment system will have access to this information to process the payment.

The Client has the right to access and to correct to the personal data relating to the Client.

Following the French Law “Informatique et Liberté” n°78-17 of January 6th 1978, the Client has the right to access and to correct its personal data.

 

 


C - Licence Agreement

LICENCE AGREEMENT

Use of ETSI's EDS Subscription Service by the Client is subject to the following Licence Agreement. The Client is the company or individual subscribing to the EDS Subscription Service.

1. Licence

The EDS shall only be used as follows:

·              The EDS can be used by the Client and his employees to:

-        further the work of ETSI or any standards body developing related standards;

-        provide guidance for the Client's product or service development and implementation;

-        serve as a support for documentation associated with a product or service of the Client,

·              The EDS can be installed and used on computer networks owned and controlled by the Client and its wholly owned subsidiaries and their respective employees,

·              Each employee of the Client is authorised to download or print the data or any portion thereof,

·              The Client may not copy, download or post any portion of the EDS into a publicly accessible site or network,

·              The Client may not create derivative works based on the EDS or any portion thereof,

·              The Client may not de-compile, reverse engineer, attempt to disassemble or reveal the proprietary, programming techniques or structure used in the software,

·              The Client may not copy, sell, sub-licence, or allow third parties to use the EDS or any part of the information obtained through the EDS, other than as stated above.

2. Compliance with Licence

Upon ETSI's request, the Client will within thirty 30 days, fully document and certify that its use of the EDS at the time of the request is in conformity with this Licence Agreement.

3. Copyrights and Patents

ETSI owns all copyrights in the content of the EDS. The Client acquires no ownership rights to the EDS whatsoever.

The ETSI Deliverables may contain patents and patent applications, which have been notified to ETSI as being essential, or potentially essential, to ETSI standards. Unless otherwise specified, all IPRs contained herein have been notified to ETSI, with an undertaking from the owner to grant licenses according to  Article 6.1 of the ETSI IPR POLICY (http://www.etsi.org/ipr/)

4. Liability

Whilst every care has been taken in the preparation of the information contained in the EDS, errors in content, typographical or otherwise, may occur. Comments or corrections should be addressed to editor@etsi.org .  ETSI shall not be liable for any damage resulting from such errors or for any unauthorised use of the information. 

5. Term

This Licence Agreement expires 15 years after the end of the selected subscription service.

6. Assignment

The Client shall not assign this Agreement or any right hereunder, either in whole or in part, without the prior written consent of ETSI.


A - Special Terms And Conditions For The EDS

A - Special Terms And Conditions For The EDS

1. EDS Description

The ETSI Documentation Service (EDS) is an information service providing the up to date full library of deliverables (standards and recommendations) adopted by ETSI.

It consists of two parts:

-           the deliverables on EDS DVD-ROM; and

-           the EDS On-Line Update on the ETSI Server. All new and revised deliverables, published or dispatched for ETSI standards approval procedures, are available since the last release of the DVD-ROM by this application.

The CD-ROM format will be only available for subscriptions that were set up before 31 May 2002 and until the end of year 2002. From the 1st quarter of 2003, only DVD-ROM format will be available.

From 2002 the EDS (i.e. one updated DVD-ROM per quarter and the access to the EDS On-Line Update) is included in the First Unit of Contribution of the ETSI Membership fee.

2. EDS Subscription and Optional Purchase

a. EDS Annual Subscription

An annual subscription to the EDS entitles the Client to:

- receive the EDS DVD-ROM, containing the full library of ETSI deliverables once every quarter, until the end of the year as of the date of the order.

- access to the EDS On-Line Update on the ETSI Server during the period of subscription as of the date of the order.

b. EDS Quarterly Subscription Option Purchase(DVD-ROM only)

The EDS DVD-ROM may be brought by non ETSI Members on a quarterly basis. A quarterly optional purchase of the EDS entitles non ETSI Members to

- receive one release of EDS DVD-ROM, containing the full library of ETSI deliverables at the time of order.

4. Method of payment

a) When ordering the EDS directly to the ETSI Distribution Service (i.e. by letter, fax, mail or phone), the Clientreceive an invoice, payable within 30 days, together with the delivery of the first set of EDS DVD-ROM.

b) When ordering the EDS on the ETSI e-shop service, the Client’s order and payment transaction are processed automatically online and the Client receives an invoice marked "Paid" together with the delivery of the first set of EDS DVD-ROM.

5. Delivery

Subject to available stocks, ETSI will endeavour to ship the EDS DVD-ROM within 5 working days of acceptance of the order by ETSI.

The EDS DVD-ROM is delivered at the Client's choice either:
- by regular post, or

- by express delivery by a selected carrier.

The cost of delivery will be borne by ETSI if it is made by regular post and by you if you select express delivery.

 

 


B - Special Terms and Conditions for the GSM-SMG Archive DVD-ROM

1. Description

The GSM-SMG Archive DVD-ROM includes:
- the meetings reports of every GSM/SMG plenary meeting from 1983 to 2000 (meeting No.1 to meeting No.32),
- all Temporary Documents from meeting No.6 to meeting No.32.

2. Price

The price of the GSM-SMG Archive DVD-ROM is 85 Euro per copy. This price does not include VAT.

3. Method of payment

Clients will receive an invoice, payable within 30 days, together with the delivery of GSM-SMG Archive DVD-ROM.

4. Delivery

Subject to available stocks, ETSI will endeavour to ship the GSM-SMG Archive DVD-ROM within 5 working days of acceptance of the order by ETSI. The GSM-SMG Archive DVD-ROM is delivered at the Client’s choice either:
- by regular post, or
- by express delivery by a selected carrier.
The cost of delivery will be borne by ETSI if it is made by regular post and by you if you select express delivery.


C - Special Terms and Conditions for the SMG# 32 CD-ROM

1. Description

The ETSI SMG #32 CD-ROM includes:
- the SMG#32 meeting report, including available annexes.
- a complete set of the temporary documents considered during the SMG#32 plenary meeting.
- a complete set of Phase 2 and Phase 2+ specifications which include new working versions of some specifications incorporating the changes agreed at SMG#32. Please note that this is not a complete set of post-SMG#32 specifications, but only those which were available at the time the content of this CD-ROM was finalised.

2. Price

The price of the SMG #32 CD-ROM is 85 Euro per copy. This price does not include VAT.

3. Method of payment

Clients will receive an invoice, payable within 30 days, together with the delivery of SMG #32 CD-ROM.

4. Delivery

Subject to available stocks, ETSI will endeavour to ship the SMG #32 CD-ROM within 5 working days of acceptance of the order by ETSI. The SMG #32 CD-ROM is delivered at the Client's choice either:

D - Special Terms and Conditions for the ETSI CD-ROM "Security for ICT"

1. Description

The ETSI CD-ROM "Security for ICT" includes:
ETSI White Paper No.1, "Security for ICT - the Work of ETSI" together with all of the reference material to which the White Paper refers.

2. Price

The price of the ETSI CD-ROM "Security for ICT" is 100 Euros per copy. This price does not include VAT.

3. Method of payment

Clients will receive an invoice, payable within 30 days, together with the delivery of the ETSI CD-ROM "Security for ICT".

4. Delivery

Subject to available stocks, ETSI will endeavour to ship the ETSI CD-ROM "Security for ICT" within 5 working days of acceptance of the order by ETSI. The ETSI CD-ROM "Security for ICT" is delivered at the Client's choice either:
- by regular post, or
- by express delivery by a selected carrier.
